I just downloded a template with all the file from http://www.opendesigns.org . in the template footer, there is a link to the authors website. when i visit that site, same template for sale there with 3 packages. now i am confused. here i got all. but there in his site it is commercial. now can i use the downlod template with css, js etc files?

thats just kindof like a freebie. jen has a couple templates free for download in hopes that you might buy other ones.
yes, I think you should be able to use it, because the user looks like he is from the site. If you are going to use it for business though, I would just contact them, just to be safe.

The same user created both designs. Her name is Jenna, a long time open source web designer:

She owns the One Dollar Template site. She, like most designers is trying to earn a little something on her work, so the designs are provided free on OD, but if you buy them from her site, you get some extra goodies with the download.
Oh and before anyone brings it up, yes she has multiple accounts on OD, the one I listed above (her main one) and then:
